Welcome to eCATLOG ("we", "us", "our"), a digital catalog and online ordering platform operated for businesses in India and elsewhere. By creating an account, accessing, or using eCATLOG (the "Service"), you ("you", "user", "client") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Service.
This document is an electronic record published in accordance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 ("DPDP Act"), and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules"), and, where applicable to users outside India, the General Data Protection Regulation ("GDPR").
You must be at least 18 years old and capable of entering into a legally binding contract to use the Service. By registering, you confirm that the information you provide (firm name, contact details, email, GST number, etc.) is accurate and belongs to you or a business you are authorized to represent.
eCATLOG allows businesses to create digital product catalogs, share them with customers via a public link, and receive orders/enquiries. Features, storage limits, and number of catalogs/products available depend on your subscription plan.
You agree not to use the Service to upload, list, advertise, or sell:
You are solely and fully responsible for ensuring that everything you list is legal to sell in your jurisdiction. We do not pre-screen catalog content before publication but actively respond to reports and may use automated or manual checks. Violation of this section may result in immediate content removal, account suspension or termination without refund, and reporting to law enforcement authorities where required by law.
Anyone (including customers, the public, or rights holders) can report a catalog, product listing, or image they believe violates these Terms or applicable law by emailing support@ecatlog.com with the catalog link and details of the concern. We aim to review and act on valid reports — including content takedown — within 36 hours of receipt of a valid complaint or court/government order, consistent with the IT Rules, 2021. Repeat or serious violations result in permanent account termination.
eCATLOG acts as an intermediary platform that allows businesses to host and share their own product catalog content; we do not create, select, or modify the product listings uploaded by users. We are entitled to "safe harbor" protection under Section 79 of the Information Technology Act, 2000, provided we observe due diligence as required under the IT Rules, 2021, including the grievance redressal process below.

eCATLOG provides tools to receive product orders/enquiries from your customers but is not a party to the transaction between you and your customers. We are not responsible for product quality, delivery, pricing accuracy, payment collection, disputes, refunds, or any other aspect of the transaction. You are solely responsible for fulfilling orders and complying with applicable consumer protection, GST, and e-commerce laws.
The eCATLOG name, logo, software, design, and underlying technology are the exclusive property of eCATLOG and its licensors. Nothing in these Terms grants you any right to use our trademarks or branding except as necessary to use the Service as intended (e.g., "Powered by eCATLOG" branding on Free plan catalogs, unless removed under an eligible paid plan).
The Service may rely on third-party providers (e.g., cloud storage/image hosting, email delivery, payment gateways). We are not responsible for outages, errors, or data loss caused by third-party service providers, though we will make reasonable efforts to maintain service continuity.
We collect and process personal data (yours and, where applicable, your customers') only as necessary to operate the Service, in accordance with our Privacy Policy. We do not sell your personal data to third parties. You are responsible for obtaining any consents required from your customers before collecting their data (e.g., name, phone number) through your catalog.
We strive to keep the Service available at all times but do not guarantee uninterrupted, error-free, or 100% uptime access. We may suspend the Service temporarily for maintenance, upgrades, or due to circumstances beyond our reasonable control ("force majeure"), including but not limited to: natural disasters, pandemics/epidemics, war, terrorism, civil unrest, labor strikes, power outages, internet/ISP disruptions, or third-party hosting/cloud provider failures. We shall not be liable for any delay or failure to perform caused by such events.
To the maximum extent permitted by law, eCATLOG and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of (or inability to use) the Service. Our total aggregate liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
You agree to indemnify and hold harmless eCATLOG, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party right.
We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice at least 7 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India. Parties agree to first attempt to resolve any dispute amicably through good-faith negotiation before initiating legal proceedings.
